CONSTRUCTION LAW & LITIGATION

Howland Hess Birnbaum has achieved regional recognition for its successes in the representation of members of the construction industry. Having represented clients in every category of construction, Howland Hess Birnbaum has successfully resolved disputes at all levels of complexity arising from a wide range of construction projects, from moderately sized projects to mega-projects in both the public and private sectors. The firm has particular expertise in projects such as schools, government buildings, highways and other private projects and residential communities. The firm represents major contractors, owners, design professionals, subcontractors, material suppliers, vendors, sureties and other construction industry participants with matters throughout Pennsylvania and New Jersey. Representations include prosecuting and defending construction claims for delay, disruption and acceleration of work, extra work and change order disputes, bid disputes, surety law matters including payment and performance bond claims, mechanics' lien claims, OSHA claims and project safety matters, claims for defective work and related construction law matters. 

The firm has expertise in pursuing and defending claims where, for example, the Pennsylvania Prompt Payment Act under Pennsylvania's Procurement Code, 62 Pa.C.S.A. SS 3901, et seq., the Pennsylvania Contractor and Subcontractor Payment Act, 73 P.S. SS 501, et seq., and/or the "Little Miller Act" under Pennsylvania's Bond Law, 8 P.A. SS 191, et seq., are at issue. 

The firm's construction practice also involves expertise in drafting and reviewing construction contracts, including the American Institute for Architects standard AIA contracts.
